Limited New Product Warranty

Warranty Coverage for Standard Products

Companion Systems Inc. (CSI) warrants your product to be free from defects in material and workmanship for a period of one year from the date of shipment. If a defect in a product covered by this warranty is discovered, we will repair or replace any product part manufactured by CSI that is proven to be defective in material or workmanship free of charge, including parts and labor.

Accessories supplied in conjunction with CSI products will be covered by the guarantee of the manufacturer of that accessory.

CSI will determine, after presentation of photos and/or other pertinent information, whether or not the warranty applies. CSI reserves the right to determine whether the part will be repaired or replaced, and whether it will be a repair in the field or at the factory.

Exclusions and Limitations

This warranty does not include any service or materials provided for the installation of the product either by CSI or by any other independent contractors hired by the customer or by CSI.

Repair and service adjustments caused by misuse, negligence, vandalism, modification, alteration, tampering, disconnection of factory installed parts, improper adjustments or repairs, accident, parts not supplied by CSI, add-on parts, improper maintenance, lack of required maintenance, or repairs or adjustments by individuals or companies not authorized by CSI, are not covered by this warranty. If CSI determines that the product must be returned to the factory for repairs or replacement, the freight costs are not covered by warranty.

This express warranty excludes all other warranties or representations expressed or implied by any literature, data, or person. CSI's maximum liability under this exclusive remedy shall never exceed the cost of the subject product. CSI reserves the right, at its sole discretion, to refund the purchase price in lieu of repair or replacement.

CSI will not be responsible or liable for indirect or consequential damages of any kind, however arising, including but not limited to those for use of any products, loss of time, inconvenience, lost profit, labor charges, or other incidental or consequential damages with respect to persons, business, or property, whether as a result of breach of warranty, negligence or otherwise. Notwithstanding any other provision of this warranty, buyer's remedy against CSI for products supplied or for non-delivered products or failure to furnish products, whether or not based on negligence, strict liability or breach of express or implied warranty, is limited solely, at CSI's option, to replacement of or cure of such nonconforming or non-delivered products or return of the purchase price for such products and in no event shall exceed the price or charge for such products. CSI expressly disclaims any warranty of merchantability or fitness for a particular use or purpose with respect to the product sold. There are no warranties which extend beyond the descriptions set forth in this warranty, notwithstanding any knowledge of CSI regarding the use or uses intended to be made of the products, proposed changes or additions to products or any assistance or suggestions that may have been made by CSI personnel.

Warranty is not transferable. This warranty applies only to the original purchasing institution. It does not apply to subsequent owners. This is the only express warranty authorized by CSI. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.
